1. Acceptance of Terms
By installing and using Track Center (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not install or use the App. These Terms constitute a legally binding agreement between you (“Merchant”) and the legal entity identified in the footer.
2. Description of Service
Track Center is a Shopify application that provides shipment tracking and order fulfillment management tools. The App synchronizes with your Shopify store to import orders, track shipments through various carriers, and display tracking information to you and your customers.
3. Subscriptions & Billing
Track Center offers subscription plans managed through Shopify's Managed Pricing system. All charges, including recurring subscription fees, are billed on your Shopify invoice. Plan details, features, and pricing are presented at the time of subscription and are subject to change with prior notice. You may upgrade, downgrade, or cancel your subscription at any time through your Shopify admin. Cancellation takes effect at the end of the current billing cycle; no refunds are provided for partial periods unless required by applicable law.
4. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:
- Use the App in any way that violates applicable laws or regulations.
- Attempt to reverse engineer, decompile, or extract the source code of the App.
- Use the App to transmit malware, spam, or other harmful content.
- Interfere with or disrupt the integrity or performance of the App or its infrastructure.
- Use the App in a manner that infringes on the rights of third parties.
5. Intellectual Property
The App, including its code, design, documentation, and branding, is the intellectual property of the legal entity identified in the footer. These Terms do not grant you any right, title, or interest in the App other than the limited license to use it as intended. All trademarks, service marks, and trade names are the property of their respective owners.
6. Disclaimers & Limitation of Liability
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the App will be uninterrupted, error-free, or that defects will be corrected. Tracking updates depend on third-party carrier APIs and may experience delays or inaccuracies.
To the fullest extent permitted by applicable law, the legal entity and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of revenue, profits, data, or business opportunities.
7. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property) shall survive.
8. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated to you with reasonable notice. Your continued use of the App after the updated Terms take effect constitutes acceptance of the changes. We encourage you to review this page periodically.
